Effective as of the date you make your first payment to Real Deal Empyre LLC ("Real Deal Empyre," "we," "us") for the Services described below.

This Agreement is between Real Deal Empyre LLC and the business or individual purchasing Services ("Client," "you"). It works alongside our Terms of Service and Privacy Policy — if anything here conflicts with those, this Agreement governs for the specific project it covers.

1. Scope of Services

This Agreement covers whichever of the following you've actually purchased:

Anything not covered in the original scope discussion (a new page type, a feature never discussed, work on a second site) is out of scope and handled under Section 7 (Change Requests) — not silently absorbed into the original price.

Doing this work correctly often requires real access to systems you already own or control — for example: your website or CMS, hosting account, domain registrar, Google Business Profile, an email needed for a verification step, or (only if that specific work is part of the engagement) social media accounts.

4. Data Protection and Confidentiality

We will not steal, copy, sell, share, publish, or otherwise use your data, files, credentials, business information, or any private or proprietary material for any purpose outside performing the agreed Services — regardless of what platform or type of access was granted under Section 3. Both parties agree to keep confidential any non-public business information shared during the engagement (business plans, credentials, financial details) and to use it only for the purposes of this Agreement. We do not retain copies of your credentials or files beyond what's needed for the active engagement.

5. What We Need From You

We can only move as fast as you provide what a project genuinely needs: accurate business information, and where applicable, your own content (copy, photos, logo, brand assets) in a reasonably timely manner. If content is late or incomplete, the project timeline moves accordingly — we'll always say plainly what's blocking progress rather than let a project silently stall or blame you after the fact.

6. Revisions

The Website Build includes two rounds of revisions on the finished site before final approval and the second payment. A "round" means you review the site once and provide one consolidated list of requested changes; we make those changes and present the updated site again. Additional revision rounds beyond the two included, or revisions requested after final approval and go-live, are billed at $75/hour, quoted before any additional work begins — never charged as a surprise after the fact.

7. Change Requests (Out-of-Scope Work)

Work beyond the original agreed scope — during the build or after go-live — is quoted separately before it starts, either as a flat fee or at the $75/hour rate from Section 6, whichever fits the request better. You always get a real quote to approve before out-of-scope work begins.

8. Ownership

Once your Website Build is paid in full, you own the final website design and content built for you. We retain ownership of our own general tools, code libraries, and build methods (the reusable "how," not your specific site). Domain: if you supply your own domain, you keep full ownership and control at all times. If we register a domain on your behalf, this only happens after you've explicitly approved the exact domain name and the real registration cost (typically ~$10–20/yr through Cloudflare Registrar) — we'll confirm in writing who holds the registrar account and how ownership transfers to you before registering anything. Hosting: while the Core Offer subscription is active, we host the site. If you cancel the Core Offer, we'll work with you on a real handoff rather than simply taking it offline without warning — see Section 9.

9. Term, Cancellation, and Site Handoff

The Website Build portion of this Agreement is complete once the finished site is approved, paid in full, and live. The Core Offer subscription continues month-to-month until you cancel (see Terms of Service Section 4) or we end it for non-payment after outreach. If the Core Offer is cancelled: we'll work with you on a real handoff — providing a way to take the site's content and, if you want to host it elsewhere, reasonable help pointing the domain to a new host, plus removing or returning any access granted under Section 3. This isn't held hostage; a client leaving is a client leaving, not a reason to break what they paid to have built.

10. Warranty and Limitation of Liability

We build and maintain the site carefully and stand behind the work, but make no guarantee of specific search rankings, traffic, or revenue outcomes, since those depend on real factors outside our control. To the extent allowed by law, total liability under this Agreement is limited to the amount you actually paid in the twelve months before any claim. Neither party is liable for indirect, incidental, or consequential damages. Full detail in our Terms of Service Section 7.

11. Governing Law

This Agreement is governed by the laws of the State of New Mexico, consistent with our Terms of Service.

12. Acceptance
